My father left his modest estate to my sibling and I , stating that everything is to be split 50-50, and that we would co-own the home until it is sold. He also made me the executor. The will does not have to go through probate as our names have been on the deed for almost 20 years. I have been advised by family friends that my sibling is going to try to contest the will on the grounds our father verbally agreed to change it, leaving her essentially everything, but never followed through. Of course, in our state, there is not a court that would even hear the case as it does not meet any of the criteria for contesting a will. So, she is stalling, ignoring my requests to meet so we can divide everything. Can I file a complaint with the court if she keeps hindering me from doing my job

Get an attorney. He/she should be able to make quick work of any attempt to argue some kind of verbal change, but court is always a cr apshoot for people representing themselves.

I met with an attorney today. He said she has no case whatsoever.She has gone to several friends of my father asking if he had ever mentioned an intention to change his will. All she has accomplished is to make herself look like a nut. In all seriousness, I think my sister is mentally ill. I am not just saying that. I mean it

I feel for you my friend. I have had to be the exec of both my sisters wills. The first one drove a wedge that has never healed. The second one seems to be working well. BUT I still remember the first which involved a COG pastor. It still hurts that I am considered to have not 'done the right thing'.Both were handled by an attorney, I only signed papers, and still the first one left bad feelings that we have NEVER had in out families.I hate it you are having problems with a 'simple' job (as some folk say). Some facts but mostly just my [email protected]/

I do not see how myself, my wife and my kids can continue to have a normal relationship with her without diplomatically, gently, yet firmly confronting her. I will always have that creepy feeling in my gut if I don't get this out of my heart. And let her take my kids anywhere? No!
